Public Offer, License Agreement and Terms of Sale

This document is the official offer of the independent creator Vyacheslav Vladimirovich Nikolaev (the "Seller") and sets out the general terms of sale for digital and physical goods, as well as the license rights granted for the use of musical works and books, on the website arives.ru.

By completing payment for any item on the Site, the buyer ("Buyer") accepts this offer in full and becomes bound by these terms.

1. Definitions and Types of Goods

• Digital good — musical works, EPs, instrumentals in audio formats (WAV, FLAC, MP3, AAC), and e-books in digital formats (PDF, EPUB, FB2, etc.).

• Physical good — printed editions of books authored by V. V. Nikolaev.

• Site — the website at arives.ru.

• Payment platforms — the international payment platforms Lava.top and Boosty.to (for digital goods) and, for buyers within Russia, YuMoney (for printed books and other services).

2. Scope and Rules of Use

2.1. Musical Works (Tiers and Licenses)

• "Personal" tier (FLAC 16-bit / 44.1 kHz, AAC 192 kbps, MP3 320 kbps): For personal, non-commercial listening only. Use in videos, covers, advertising, or games is not permitted.

• "Studio" (FLAC 24-bit / 48.0 kHz) and "Studio Master" (WAV 32-bit Float / 48.0 kHz) tiers: A perpetual, worldwide, non-exclusive, royalty-free license granting the right to:

  • use the music as background music in videos (YouTube, VK, Rutube, Twitch, TikTok, Telegram, Instagram), advertising, film, podcasts, apps, and games;

  • record video covers (a vocal performance over the instrumental) with mandatory attribution: "Music: Vyacheslav Nikolaev (arives.ru)";

  • edit the audio (trimming, looping) as needed for a video project.

• Restrictions: Reselling the raw source files, registering tracks or covers with digital fingerprinting systems (such as YouTube Content ID), or uploading covers to music streaming services (Spotify, Apple Music, YouTube Music, etc.) is not permitted without the Seller's separate written consent.

2.2. E-books

• The Buyer is granted the right to download and read the e-book on personal devices for personal use.

• Not permitted: reselling book files, making them freely available (torrents, file-sharing channels, library repositories), or creating audiobooks or translations based on them without the author's written consent.

2.3. Printed (Physical) Books

• The Seller will deliver a printed book of appropriate quality to the Buyer after full payment has been received.

• Printed books are currently shipped via Russian domestic post and are primarily intended for buyers within Russia. International buyers interested in a printed copy should contact the Seller in advance to confirm availability and shipping options.

3. Disclaimer Regarding Content

3.1. Books and articles authored by V. V. Nikolaev (including "The Path to Healing: My Struggle with a Herniated Disc" and "How I Quit Smoking Using the Knowledge of the Ancients") are provided for informational and personal-experience-sharing purposes only. They do not constitute instructions or a call to action.

3.2. In these materials, the author shares his personal opinions and experiences. Nothing in these materials should be understood as an assertion of fact, and the author does not present his views as the only correct approach. The materials do not promote or disparage any religious or philosophical belief system.

3.3. The materials and books are not medical, legal, or financial advice, a diagnosis, or a treatment recommendation. Always consult a qualified professional (such as your physician) before making decisions about your health. The Seller is not liable for decisions made by readers based on these materials.

4. Payment and Delivery

4.1. Digital goods: Paid for and delivered through Lava.top and Boosty.to, both of which support international cards and multiple currencies (including USD and EUR). Access and download links are provided automatically immediately after payment.

4.2. Physical (printed) books: Currently processed primarily through YuMoney for buyers within Russia; shipped exclusively via Russian domestic post. Delivery timing depends on the destination and is handled per the postal carrier's own estimates.

4.3. Third-party platforms: If you follow a link from the Site to an external marketplace, that transaction is subject to the terms of that external platform, not this offer.

4.4. Pre-orders: For pre-orders of not-yet-released printed editions, the delivery period is counted from the date the print run actually becomes available. Estimated release dates are shown on the relevant product page.

5. Refund Policy

5.1. Digital goods: Because digital files can be copied instantly upon delivery, digital goods of proper quality are generally non-refundable once delivered, consistent with standard digital-goods practice. A refund will be issued if a technical error occurs (such as a duplicate payment or a failed file delivery).

5.2. Physical (printed) books:

• Goods without defects: The Buyer may cancel an order before it ships, or return the book within 14 days of receipt provided it is in its original, undamaged condition. Return shipping costs are the Buyer's responsibility unless the return is due to a Seller error.

• Printing defects: Claims regarding printing defects (missing or illegible pages, binding faults, etc.) are accepted within 14 days of the Buyer receiving the order.

• To report a defect, the Buyer should send photo or video evidence to the Seller's e-mail or via the contact form.

• Once a defect is confirmed, the Seller will, at its own expense, either send a properly printed replacement copy or issue a full refund.

6. Governing Law

6.1. The Seller is an individual based in the Russian Federation. This offer is intended to reflect generally recognized international consumer-protection and e-commerce principles. Nothing in this offer limits any mandatory consumer rights you may have under the law of your own country of residence.
